These Terms explain the relationship between you and eLegacy, your responsibilities while using the platform, and the responsibilities we assume in providing our services.

By creating an account, accessing, or using eLegacy, you agree to be bound by these Terms. If you do not agree with these Terms, you should not use the platform.

Keeping individual accounts separate helps maintain accurate records, appropriate permissions, and the security of your estate information.

Protecting your account is one of the most important ways you can help protect your estate information. Choosing a strong password and maintaining current contact information can significantly improve the security of your account.

eLegacy is a comprehensive estate planning and estate organization platform designed to help individuals prepare, manage, maintain, and securely organize the information that supports their estate plan throughout their lifetime.

The platform combines secure information management, AI-assisted document generation, document storage, estate organization, beneficiary collaboration, and long-term estate maintenance into a single integrated experience.

Depending on your subscription and the features you choose to use, eLegacy may provide tools and services including:

As part of this ongoing development, certain features may be added, modified, replaced, or retired over time.

Whenever practical, we strive to make these changes in ways that preserve your information and provide a positive user experience.

Your subscription determines which features are available to you. Some capabilities are available to all users, while others require a Pro or Premium subscription.

AI-Assisted Document Generation

eLegacy provides AI-assisted tools designed to help users prepare estate planning documents, organize estate information, and streamline the estate planning process.

These features generate personalized draft documents and other supporting content using the information you provide, your responses during guided interviews, and any optional instructions you choose to include.

AI-assisted features are intended to assist you—they do not replace your judgment or the advice of qualified legal, financial, or tax professionals.

Your Responsibility

You are responsible for reviewing all AI-generated content before relying upon, signing, distributing, or storing it as part of your estate plan.

You should carefully verify that generated documents accurately reflect:

  • Your intentions
  • Your family relationships
  • Your beneficiaries
  • Your assets
  • Your fiduciary appointments
  • Your distribution wishes
  • Any special instructions you provided

If you believe a generated document is inaccurate or incomplete, you should update your information, revise your responses, or regenerate the document before using it.

Professional Advice

eLegacy is not a law firm and does not provide legal advice.

AI-generated documents should not be interpreted as legal, financial, tax, or other professional advice.

Depending on your individual circumstances, you may wish to consult a licensed attorney or other qualified professional before executing estate planning documents or making significant legal decisions.

AI Availability

AI-assisted features may improve, evolve, or change over time as technology advances and the platform continues to develop.

Generated content may vary based on the information provided and improvements made to the AI systems supporting the platform.

Good to Know

AI is designed to help you prepare your estate planning documents more efficiently. Final decisions regarding your estate plan—including whether to use, revise, or execute any generated document—always remain yours.

User Responsibilities

By using eLegacy, you agree to use the platform responsibly and in accordance with these Terms.

You are responsible for the information you choose to provide, the documents you upload, the estate planning decisions you make, and the actions taken through your account.

You agree to use the platform in a manner that respects the rights of others and supports the security, integrity, and intended purpose of the services we provide.

As an eLegacy User, You Agree To

  • Provide information that is accurate to the best of your knowledge.
  • Keep your account information reasonably current.
  • Review AI-generated documents before relying upon or executing them.
  • Maintain the confidentiality of your account credentials.
  • Respect the privacy and rights of individuals whose information you include within your estate.
  • Use the platform only for lawful purposes.
  • Refrain from attempting to interfere with the security or operation of the platform.
  • Comply with all applicable laws and regulations while using eLegacy.

Responsible Estate Planning

As your family, financial situation, beneficiaries, assets, or personal wishes change, you are responsible for reviewing and updating your estate information so it continues to reflect your intentions.

Regularly reviewing your estate plan helps ensure your information remains accurate, complete, and useful to those who may rely upon it in the future.

eLegacy is designed to help organize and manage your estate planning information, but the accuracy of your estate plan ultimately depends on the information you choose to provide and maintain.

User Content & Document Ownership

You retain ownership of the information, documents, and content you create, upload, or store within your eLegacy account.

This includes the personal information, estate planning information, uploaded files, AI-generated documents you choose to save, photographs, notes, and other materials that you provide while using the platform.

eLegacy does not claim ownership of your estate planning documents or the personal information you choose to organize within the platform.

By using eLegacy, you grant us only the limited rights necessary to host, store, process, transmit, display, back up, and otherwise manage your information for the purpose of providing the services you request.

Your Content

Examples of content you own include:

  • Estate planning documents
  • Uploaded legal documents
  • Identity documents
  • Financial information
  • Insurance information
  • Property and asset information
  • Digital asset information
  • Beneficiary information
  • Estate notes
  • Files and photographs you upload

Your ownership of this content does not change simply because it is stored or managed within eLegacy.

Our Platform

While you retain ownership of your content, eLegacy owns the platform itself, including its software, applications, website, design, branding, user interface, documentation, and other proprietary technology.

These Terms do not transfer ownership of eLegacy’s intellectual property to users, nor do they transfer ownership of your estate information to eLegacy.

Your legacy remains your legacy.

Our role is to help you organize, protect, and manage it—not to own it.

Identity Vault, Secure Vault & Information Storage

eLegacy provides secure tools that help you organize, maintain, and manage important estate planning information throughout your lifetime.

Depending on the features you choose to use, this may include Identity Vault, Secure Vault, Legal Documents, Digital Assets, financial information, insurance records, estate contacts, uploaded files, and other information that supports your estate plan.

These tools are intended to help you organize and maintain your information in a secure and structured manner so it is available when you need it.

Identity Vault

Identity Vault is designed to help you securely organize government-issued identity documents and other important personal records associated with you or, where supported, your co-grantor.

Examples may include:

  • Social Security cards
  • Driver’s licenses
  • Passports
  • Birth certificates
  • Marriage certificates
  • Military records
  • Medicare or Medicaid cards
  • Other government-issued identity documents

Some document types may not apply to every individual. eLegacy allows you to indicate when certain documents are not applicable so your estate records accurately reflect your personal circumstances.

Secure Vault

Secure Vault serves as a centralized security dashboard that helps you organize and monitor sensitive estate information stored throughout the platform.

Depending on your subscription and usage, Secure Vault may provide access to information relating to:

  • Legal documents
  • Financial accounts
  • Insurance policies
  • Digital accounts
  • Estate contacts
  • Security monitoring tools
  • Emergency Access
  • Trusted Access
  • Security Audit features

Secure Vault helps organize these categories but does not replace your responsibility to maintain current and accurate estate information.

Your Responsibility

You are responsible for ensuring that the information you choose to store within the platform remains accurate and reasonably up to date.

Because estate planning changes over time, we encourage you to periodically review your stored information and update documents as circumstances change.

Good to Know

Identity Vault and Secure Vault are designed to complement one another.

Identity Vault focuses on organizing personal identity documents, while Secure Vault provides a broader view of sensitive estate information across your account.

Beneficiary Portal & Secure Sharing

eLegacy includes features that allow you to securely share selected estate information with individuals you designate.

These features are designed to help facilitate estate planning, collaboration, and, when appropriate, the transition of important information to beneficiaries, executors, trustees, attorneys, or other trusted individuals.

Sharing features are always intended to support your estate planning decisions—not replace your control over your information.

Beneficiary Portal

The Beneficiary Portal provides designated beneficiaries with access to information that you choose to make available, subject to the permissions, eligibility requirements, and release conditions supported by the platform.

Access to the Beneficiary Portal may require:

  • A valid invitation from the estate owner.
  • Account registration and identity verification.
  • Acceptance of applicable terms.
  • Completion of any required authorization steps.
  • Satisfaction of any applicable access or release conditions.

Access to information through the Beneficiary Portal may change over time depending on your estate planning decisions, account settings, or the progression of supported estate workflows.

Secure Sharing

Secure Sharing allows you to provide selected information to trusted recipients without granting unrestricted access to your account.

Depending on the sharing options available, you may control:

  • What information is shared.
  • Who receives access.
  • How long access remains available.
  • Whether access may be modified or revoked.
  • Other sharing preferences supported by the platform.

You remain responsible for selecting recipients and determining what information you choose to share.

Your Control

Sharing information through eLegacy is optional.

You decide whether to invite beneficiaries, create Secure Share Links, authorize Trusted Access, or enable other collaboration features available within the platform.

Whenever supported, you may review, modify, or revoke access as your estate plan evolves.

Good to Know

One of eLegacy’s guiding principles is that access should be intentional.

The platform is designed to help you decide who receives information, what they receive, and when they receive it.

Subscription Plans, Billing & Free Trial

eLegacy offers multiple subscription options designed to meet different estate planning needs. Available plans, features, and pricing are described on our Pricing page and may change over time.

Certain features are available to all users, while others require a paid subscription. Access to specific functionality is determined by your current subscription plan.

If you subscribe to a paid plan, you agree to pay all applicable subscription fees and any applicable taxes associated with your selected plan.

Free Trial

Where offered, free trials allow you to experience Premium features before purchasing a subscription.

At the conclusion of the trial period, your subscription will continue only if you choose to enroll in a paid plan or if your trial converts according to the terms presented during enrollment.

Trial eligibility, duration, and availability may change over time.

Billing

Paid subscriptions are processed through our secure payment provider.

Depending on the subscription you choose, billing may occur on a monthly or annual basis.

You are responsible for maintaining current payment information associated with your subscription.

If a payment cannot be successfully processed, access to certain subscription features may be affected until billing issues are resolved.

Plan Changes

You may upgrade, downgrade, or cancel your subscription using the subscription management tools provided within the platform.

Depending on your selected plan change, billing adjustments, prorated charges, or changes to feature availability may apply.

If you voluntarily change from a legacy or grandfathered subscription plan to a newer pricing plan, your previous pricing may no longer be available.

Cancellation

You may cancel your subscription at any time.

Unless otherwise stated during the cancellation process, cancellation generally prevents future renewals but does not automatically provide refunds for prior billing periods.

Following cancellation, you may continue to have access to paid features until the end of your current billing period, after which your account will transition to the applicable subscription level.

Whenever possible, eLegacy provides clear information about pricing, plan features, billing frequency, and the impact of subscription changes before they are confirmed.

Acceptable Use

We ask every eLegacy user to use the platform responsibly and respectfully.

Our goal is to provide a secure, reliable, and trustworthy environment where individuals and families can confidently organize and manage their estate planning information.

To help achieve that goal, you agree to use eLegacy only in ways that are consistent with these Terms and applicable laws.

You Agree Not To

While using eLegacy, you agree that you will not:

  • Use the platform for any unlawful purpose.
  • Attempt to gain unauthorized access to accounts, systems, or data.
  • Interfere with or disrupt the operation, security, or reliability of the platform.
  • Upload malicious software, viruses, or other harmful code.
  • Attempt to bypass subscription, licensing, or access controls.
  • Misrepresent your identity or impersonate another individual.
  • Use the platform to infringe upon the rights of others.
  • Attempt to reverse engineer, exploit, or compromise the platform or its underlying technology except where such restrictions are prohibited by applicable law.
  • Use automated tools or services in ways that unreasonably interfere with the operation of the platform.
  • Use eLegacy in any manner that could reasonably be expected to harm other users or the platform.

Helping Protect the Community

Every user plays an important role in maintaining the integrity of eLegacy.

If you become aware of suspected security issues, unauthorized account activity, or misuse of the platform, we encourage you to report it promptly so that appropriate action can be taken.

Responsible use helps protect not only your own information, but the information entrusted to the platform by other users as well.

If we reasonably believe these Terms have been violated, we may investigate the matter and take appropriate action to protect the platform, our users, and our services.

Depending on the circumstances, this may include limiting access to certain features, suspending an account, terminating an account, or taking other actions permitted by applicable law.

Whenever appropriate, we strive to apply these measures fairly and proportionately.

Intellectual Property

The eLegacy platform, including its software, website, applications, visual design, user interface, branding, logos, graphics, documentation, original content, and underlying technology, is owned by eLegacy or its licensors and is protected by applicable intellectual property laws.

These Terms grant you the right to access and use the platform in accordance with your subscription and these Terms. They do not transfer ownership of any intellectual property belonging to eLegacy.

What You May Do

While using eLegacy, you may:

  • Access the platform through your authorized account.
  • Create, organize, upload, and manage your own estate information.
  • Generate estate planning documents using features available under your subscription.
  • Download or print documents and information that belong to you, where supported by the platform.
  • Use the platform for your personal estate planning purposes in accordance with these Terms.

What You May Not Do

Unless permitted by applicable law or with our prior written permission, you may not:

  • Copy, reproduce, or distribute the platform or its proprietary software.
  • Modify, reverse engineer, decompile, or attempt to discover the source code of the platform, except where such restrictions are prohibited by applicable law.
  • Remove or alter proprietary notices, trademarks, or copyright information.
  • Use eLegacy’s branding, trademarks, logos, or other intellectual property in a manner that suggests endorsement or affiliation without authorization.
  • Create or distribute derivative works based upon the platform itself.

These restrictions apply to the platform and its proprietary technology—not to the estate information and documents you own.

Your Intellectual Property

Nothing in these Terms changes your ownership of the information, documents, photographs, estate planning materials, or other content that you create, upload, or maintain within your account.

Your estate remains your intellectual property and personal information.

Protecting intellectual property allows us to continue improving eLegacy while ensuring you retain ownership of the estate information and documents that are uniquely yours.

Suspension & Termination

We hope every user enjoys a positive experience with eLegacy. However, there may be circumstances in which we need to suspend or terminate access to the platform to protect our users, our services, or to comply with applicable legal obligations.

You may stop using eLegacy and close your account at any time, subject to any applicable subscription, billing, or account management requirements.

Likewise, eLegacy may suspend or terminate access to the platform if we reasonably believe it is necessary to protect the security, integrity, or lawful operation of our services.

We May Suspend or Terminate an Account If

Examples include situations where:

  • These Terms of Service have been materially violated.
  • Fraudulent, deceptive, or unlawful activity is reasonably suspected.
  • Unauthorized access to accounts or platform resources is attempted.
  • The security or stability of the platform is threatened.
  • Required subscription obligations remain unresolved.
  • We are required to do so by law or legal process.
  • Continued access could reasonably harm other users or the platform.

Whenever practical and appropriate, we will attempt to notify you before permanent account termination.

Effect of Suspension or Termination

Depending on the circumstances:

  • Access to some or all platform features may be limited.
  • Subscription benefits may end in accordance with applicable billing terms.
  • Certain information may remain subject to our Data Retention and Privacy Policy.
  • You may remain responsible for outstanding financial obligations incurred before termination.
  • Certain provisions of these Terms will continue to apply after termination where appropriate.

Termination of your account does not automatically delete all information immediately. Data handling following account closure is governed by our Privacy Policy and applicable legal obligations.

Reinstatement

If an account has been suspended because of suspected security concerns or other issues that can be resolved, you may contact our support team to request a review.

Where appropriate, and at our discretion, access may be restored after the underlying issue has been addressed.

Our goal is always to resolve issues fairly whenever possible. Suspension or termination is intended to protect the security, reliability, and trustworthiness of the platform—not to penalize users acting in good faith.

Disclaimers

We work hard to provide a secure, reliable, and continuously improving platform. However, like all online services, eLegacy is provided on an “as available” and “as provided” basis.

While we strive for accuracy, reliability, and uninterrupted availability, we cannot guarantee that the platform will always operate without interruption, delay, error, or unforeseen technical issues.

We continually maintain and improve the platform, but occasional maintenance, updates, service interruptions, or circumstances beyond our reasonable control may temporarily affect availability.

No Guarantees

Except as required by applicable law, eLegacy does not guarantee:

  • That every AI-generated result will be complete, accurate, or appropriate for every situation.
  • That all uploaded information will remain free from user error or omissions.
  • That the platform will meet every individual’s estate planning needs.

Our goal is always to provide dependable services while continually improving the platform over time.

Your Review Remains Important

Estate planning involves important personal, legal, and financial decisions.

You remain responsible for reviewing your estate information, uploaded documents, AI-generated content, and completed estate planning documents to ensure they accurately reflect your intentions before relying upon or executing them.

Circumstances Beyond Our Control

Certain events may affect the availability or operation of the platform despite our reasonable efforts.

Examples include:

  • Internet or telecommunications failures.
  • Third-party service outages.
  • Natural disasters or other force majeure events.
  • Government actions or legal restrictions.
  • Cybersecurity incidents affecting external providers.
  • Other events beyond our reasonable control.

Whenever practical, we will work to restore services as quickly as reasonably possible.

Limitation of Liability

To the fullest extent permitted by applicable law, eLegacy shall not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from or relating to your use of the platform.

This includes, but is not limited to, claims relating to lost profits, loss of business opportunities, loss of data, interruption of service, or other intangible losses, even if we have been advised that such damages might occur.

Nothing in these Terms limits or excludes liability where such limitation or exclusion is prohibited by applicable law.

Your Estate Decisions

You remain responsible for the decisions you make regarding your estate plan.

While eLegacy provides tools that assist with estate organization and AI-assisted document preparation, decisions regarding beneficiaries, fiduciaries, distributions, legal documents, and other estate planning matters remain your responsibility.

We encourage users to carefully review all information and seek professional advice whenever appropriate for their individual circumstances.

Third-Party Services

Certain features rely upon third-party service providers.

Although we carefully select providers that support our services, eLegacy is not responsible for interruptions, failures, or actions of independent third-party services that are outside of our reasonable control.

Maximum Liability

To the fullest extent permitted by applicable law, any liability arising from your use of eLegacy shall be limited to the amount you paid to eLegacy for the services giving rise to the claim during the twelve (12) months immediately preceding the event giving rise to the claim.

If you have not paid for a subscription, liability shall be limited to the maximum extent permitted by applicable law.
