Introduction

Your privacy matters.

At eLegacy, we understand that you’re trusting us with some of the most personal and important information you own. We believe that trust should be earned through transparency, responsible data practices, and giving you meaningful control over your information.

This Privacy Policy explains what information we collect, why we collect it, how it is used, and the choices available to you. Our goal is to make these practices easy to understand so you can make informed decisions about using the platform.

Throughout eLegacy, we strive to collect only the information needed to provide and improve our services while helping you organize, protect, and maintain your estate planning information.

Because eLegacy continues to evolve, this Privacy Policy may be updated periodically to reflect new features, legal requirements, or improvements to our services. When significant changes are made, we will provide appropriate notice within the platform or by other reasonable means.

By using eLegacy, you acknowledge that you have read and understand this Privacy Policy.

Our Privacy Principles

Everything we do is guided by a few simple principles:

  • Be transparent about how information is used.
  • Collect only information needed to provide our services.
  • Give users meaningful control over their information.
  • Protect information using modern security practices.
  • Continuously improve privacy alongside security.

Good to Know

Privacy and security work together. Our Privacy Policy explains how information is collected and used, while our Security page explains how that information is protected throughout the platform.

Information We Collect

To provide eLegacy’s services, we collect information that helps you create, organize, maintain, and securely manage your estate plan.

The information you choose to provide depends on how you use the platform and the features you decide to use. Some information is required to create and manage your account, while other information is optional and entered only if it supports your estate planning needs.

Information you may provide includes:

  • Account information (such as your name, email address, and account credentials)
  • Personal identity information
  • Estate planning information
  • Beneficiary and family information
  • Financial account information
  • Insurance information
  • Property and asset information
  • Legal documents
  • Government-issued identity documents
  • Digital asset information
  • Trusted contacts and professional advisors
  • Subscription and billing information
  • Communications you send to us
  • Information you voluntarily provide while using AI-assisted features

Some features also generate system information that helps operate the platform, such as account preferences, document activity, security events, and estate progress.

We collect only the information necessary to provide, improve, secure, and support the services you choose to use.

Information You Control

You decide what information you add to your estate.

Many areas of eLegacy are optional, allowing you to organize only the information that is relevant to your personal circumstances. You may also update, modify, or remove much of your information as your estate plan evolves.

Good to Know

eLegacy does not require every user to complete every section of the platform. You remain in control of what information you choose to organize, and many features can be used independently based on your individual needs.

How We Use Information

The information you provide helps eLegacy deliver the features and services you choose to use.

Our primary purpose for collecting information is to help you organize, maintain, and securely manage your estate plan while providing the tools needed to support you throughout your estate planning journey.

Depending on how you use the platform, your information may be used to:

  • Create and manage your account
  • Organize your estate planning information
  • Generate estate planning documents using AI-assisted features
  • Maintain your Identity Vault and Secure Vault
  • Manage estate roles, beneficiaries, and trusted contacts
  • Support Secure Sharing and Beneficiary Portal access
  • Process subscription payments and manage your account
  • Improve platform performance and reliability
  • Detect, investigate, and help prevent fraud, abuse, or unauthorized activity
  • Respond to customer support requests
  • Communicate important service updates, security notices, and account information
  • Comply with applicable legal obligations

We do not use your personal estate information to build public profiles or sell your personal information to third parties.

Whenever new features are introduced, we evaluate how information is used to help ensure those features remain consistent with our commitment to privacy and user control.

Purpose Before Collection

We believe information should have a purpose.

For that reason, we strive to collect and use information only when it supports the services you request or helps us improve the security, reliability, and functionality of the platform.

Good to Know

Many platform improvements are based on understanding how features are used—not on reading the personal contents of your estate documents. Whenever possible, improvements are informed by system behavior, performance metrics, and user feedback rather than the substance of your personal information.

AI Processing & Document Generation

eLegacy includes AI-assisted features that help generate estate planning documents and provide guidance throughout the estate planning process.

These features use the information you choose to provide, together with your responses during AI-guided interviews and any optional instructions you submit, to generate personalized draft documents and recommendations.

AI-generated content is intended to assist you in preparing estate planning documents. It is not a substitute for independent legal advice, financial advice, or tax advice. Depending on your individual circumstances, you may wish to consult a qualified professional before relying on any generated document.

You remain responsible for reviewing all generated content to ensure it accurately reflects your wishes before using, signing, or sharing any document.

How AI Uses Your Information

When you choose to use AI-assisted features, the information you provide may be used to:

  • Generate estate planning document drafts
  • Personalize document language based on your selections
  • Incorporate optional instructions you choose to provide
  • Produce summaries and supporting estate planning content
  • Improve the quality and consistency of generated results

AI processing occurs only when you intentionally use AI-powered features within the platform.

Your Control

You decide when AI is used.

Using AI-assisted features is optional, and you choose what information to provide during the document generation process. You may revise your information, regenerate documents, or edit generated content before deciding whether to use it.

Good to Know

Special Instructions that you voluntarily provide during document generation are used to help personalize the draft documents you request. They are intended to supplement the structured information you’ve entered elsewhere in your estate plan—not replace it.

Document Storage & File Uploads

eLegacy allows you to securely upload, organize, and manage documents that support your estate plan.

Depending on how you use the platform, these may include legal documents, identity documents, financial records, insurance information, tax records, and other files you choose to store.

Documents remain associated with your account and, where applicable, with the specific person, asset, policy, or estate record to which they relate. This organization helps make information easier to locate and maintain over time.

AI-generated estate planning documents that you choose to save are also stored as part of your estate records, allowing you to review, update, and regenerate documents as your estate plan evolves.

Types of Documents You May Store

Examples include:

  • Wills and trusts
  • Powers of attorney
  • Healthcare directives
  • Identity documents
  • Insurance policies
  • Financial records
  • Property records
  • Tax documents
  • Military records
  • Personal supporting documents

You decide which documents to upload and maintain within your estate.

Your Documents Remain Yours

The documents and files you upload remain your information.

eLegacy stores and organizes these materials to provide the services you request. We do not claim ownership of the documents you create or upload. You may update, replace, or remove documents as your estate plan changes, subject to applicable legal, operational, and account management requirements.

Good to Know

Keeping your documents organized is just as important as creating them. Regularly reviewing uploaded files helps ensure your estate information remains current, complete, and available when needed.

Third-Party Services

To provide certain features and services, eLegacy works with carefully selected third-party service providers that perform specific functions on our behalf.

These providers help us deliver services such as secure payment processing, email delivery, authentication, cloud infrastructure, and other operational functions necessary to operate the platform.

We select service providers that support our commitment to protecting your information and require them to handle information in accordance with applicable contractual obligations and privacy requirements.

Third-party providers receive only the information reasonably necessary to perform the services they have been engaged to provide.

Examples of Third-Party Services

Depending on the features you use, eLegacy may utilize third-party providers for services such as:

  • Secure payment processing
  • Email delivery and transactional notifications
  • User authentication and account security
  • Cloud hosting and infrastructure
  • Secure file storage
  • AI-assisted document generation
  • System monitoring and reliability
  • Customer support tools

Our use of third-party services may evolve over time as the platform grows and improves. We periodically review these relationships to help ensure they continue to meet our standards for security, privacy, and reliability.

Our Responsibility

Although certain services are provided by trusted third-party providers, eLegacy remains responsible for the overall experience we provide to our users.

We carefully evaluate the providers we choose and strive to work with organizations that share our commitment to protecting user information and maintaining dependable services.

Good to Know

Using specialized providers allows eLegacy to deliver secure, reliable features without requiring every service to be built from scratch. This approach helps us focus on improving the estate planning experience while working with trusted partners for specialized capabilities.

Sharing of Information

Your personal information is not sold to third parties.

eLegacy shares information only in limited circumstances that are necessary to provide the services you request, operate the platform, comply with applicable legal obligations, or when you intentionally choose to share information using features within the platform.

Whenever information is shared, we strive to limit that sharing to only what is reasonably necessary for the intended purpose.

Information May Be Shared When

Information may be shared in situations such as:

  • You choose to share documents or information using Secure Sharing features.
  • You invite a beneficiary to access the Beneficiary Portal.
  • You authorize information to be shared with trusted contacts or professional advisors.
  • Information is required to process subscription payments through our payment provider.
  • Information is required to deliver emails, notifications, or other services you request.
  • Disclosure is required to comply with applicable laws, regulations, court orders, or lawful government requests.
  • Sharing is necessary to protect the security, rights, safety, or integrity of eLegacy, our users, or others.

We do not share your estate information for advertising purposes or sell your personal information to data brokers.

Sharing Is Your Decision

Many sharing features within eLegacy are initiated by you.

Whether you choose to send a Secure Share Link, invite a beneficiary to the Beneficiary Portal, or provide access to trusted individuals, you remain in control of those decisions and may update or revoke access where supported by the platform.

Good to Know

The ability to securely share information is an important part of estate planning. eLegacy is designed to help you control not only what information is shared, but also who receives it and under what circumstances.

Cookies & Analytics

Like many online services, eLegacy uses cookies and similar technologies to help operate the platform, improve your experience, and better understand how our services are used.

Cookies help us remember your preferences, maintain secure sessions, keep you signed in when appropriate, and support the reliable operation of the platform.

We may also collect limited technical information—such as browser type, device information, pages visited, and general usage patterns—to help improve performance, identify issues, and enhance the user experience.

Whenever possible, we use this information in ways that help us improve the platform without unnecessarily identifying individual users or examining the personal contents of estate information.

Cookies Help Us

Cookies and similar technologies may be used to:

  • Keep you securely signed in
  • Remember your preferences and settings
  • Improve website performance
  • Understand how features are used
  • Help diagnose technical issues
  • Support platform security
  • Improve the overall user experience

You may be able to control certain cookie settings through your browser, although disabling some cookies may affect how portions of the platform function.

Analytics

Analytics help us understand how the platform is used so we can continue improving eLegacy.

Our goal is to learn how the platform performs—not to build advertising profiles or track your activity across unrelated websites.

Good to Know

We use cookies to help provide a better and more reliable experience. They are intended to support the operation of the platform rather than serve as a tool for advertising or selling personal information.

Your Rights & Choices

We believe you should have meaningful control over your personal information.

eLegacy is designed to give you the ability to access, review, update, and manage much of the information you provide throughout your estate planning journey.

Because your estate plan evolves over time, your information should be just as flexible.

You Can

Depending on your account and the features you use, you may be able to:

  • Access the information stored in your account
  • Update your personal and estate planning information
  • Add, edit, or remove documents and uploaded files
  • Manage beneficiaries, trusted contacts, and estate roles
  • Update subscription preferences and billing information
  • Control sharing permissions and beneficiary access
  • Review and update security settings
  • Manage notification preferences
  • Request assistance with account-related questions

Some requests may require additional verification to help protect your information from unauthorized access.

Your Choices Matter

Many features within eLegacy are optional.

You decide which information to provide, which features to use, and how you organize your estate. As your circumstances change, you remain free to update your information so your estate plan continues to reflect your wishes.

Good to Know

Protecting your privacy sometimes means verifying your identity before making certain account changes or fulfilling sensitive requests. These additional steps help protect your information from unauthorized access.

Data Retention

eLegacy is designed to help you maintain your estate plan over time. As a result, information is generally retained for as long as your account remains active or as long as it is reasonably necessary to provide the services you request.

The length of time information is retained may vary depending on the type of information, your account activity, applicable legal requirements, operational needs, and your requests regarding your account.

If you update or replace documents, earlier versions may be removed or retained for operational purposes where appropriate. Certain records may also be retained for security, fraud prevention, billing, dispute resolution, or to comply with applicable legal obligations.

When information is no longer needed for these purposes, we strive to securely remove or anonymize it in accordance with our data management practices.

Factors That Affect Retention

Information may be retained based on factors such as:

  • Whether your account remains active
  • Your document and estate management history
  • Subscription and billing records
  • Security and fraud prevention requirements
  • Customer support and dispute resolution
  • Applicable legal or regulatory obligations

Because estate planning is intended to support long-term planning, many users choose to maintain their information within eLegacy for many years.

Good to Know

Deleting or replacing information within your estate plan may not immediately remove every historical or operational record. Certain information may be retained for limited periods to support security, system integrity, legal obligations, or account administration.

Account Deletion

You may choose to close your eLegacy account at any time.

If you decide to close your account, you may request that your account and associated information be deleted, subject to applicable legal, operational, security, and billing requirements.

Because eLegacy is designed to help manage important estate information, we encourage you to carefully consider any account deletion request and ensure you have exported or otherwise retained any information you may wish to keep before completing the process.

Certain information may be retained for limited periods where necessary to comply with legal obligations, resolve disputes, prevent fraud, maintain system integrity, or complete legitimate business operations.

Before You Delete Your Account

Before requesting account deletion, you may wish to:

  • Download or save important documents you want to keep.
  • Review your Identity Vault and Secure Vault contents.
  • Remove or update any information you no longer wish to maintain.
  • Review beneficiary access and Secure Share Links.
  • Confirm that any active subscription has been cancelled, if applicable.
  • Contact our support team if you have questions about the deletion process.

These steps can help ensure you do not unintentionally lose information you may need in the future.

Good to Know

Deleting your account does not necessarily remove every operational or legally required record immediately. Certain information may be retained for limited periods as described in the Data Retention section of this Privacy Policy.
